(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 BGB). A trader is any natural or legal person or partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their trade, business or profession (§ 14 BGB).
(3) Deviating terms of the customer do not apply unless we expressly agree to them in writing.
§ 2 Conclusion of contract
(1) The presentation of products in the online shop is not a legally binding offer but an invitation to order.
(2) The customer places items in the cart, enters their details in the checkout, chooses the shipping and payment method and submits a binding offer by clicking the order button. Before submitting, the customer can check and correct all details.
(3) The contract is concluded when we accept the order with the order confirmation email, which the customer receives immediately after submitting the order.
§ 3 Prices and shipping costs
(1) All prices are final prices and include statutory VAT.
(2) Shipping costs are added as stated in our shipping information; they are shown in the checkout.
§ 4 Payment
Payment is made using the payment methods offered in the checkout; currently this is PayPal. Depending on your PayPal account, the payment options offered by PayPal are also available there (e.g. direct debit, credit card).
§ 5 Delivery
(1) We deliver to the countries listed in the shipping information.
(2) The delivery time is stated in the shipping information or with the item.
(3) For traders, the risk passes to the customer when the goods are handed over to the carrier.
§ 6 Retention of title
The goods remain our property until paid in full. For traders, we additionally retain title until all claims arising from the ongoing business relationship have been settled.
§ 7 Right of withdrawal
Consumers have a right of withdrawal. Details are given in our cancellation policy.
§ 8 Cut-to-length and custom-made profiles
Profiles cut to length or specially made according to the customer's wishes are produced individually for the customer. The right of withdrawal nevertheless applies to profiles cut to length (see the cancellation policy).
§ 9 Warranty
(1) The statutory rights in the event of defects apply.
(2) For traders, the limitation period for claims for defects is one year from delivery; the duty to inspect and give notice of defects under § 377 HGB remains unaffected. This does not apply to claims for damages under § 10.
§ 10 Liability
(1) We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the German Product Liability Act.
(2) In the event of a slightly negligent breach of an essential contractual obligation (an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance the customer may regularly rely), liability is limited to the foreseeable damage typical for the contract. Otherwise, liability for slight negligence is excluded.
§ 11 Language and text of the contract
The language of the contract is German. We store the text of the contract; the customer receives the order details and these terms by email.
§ 12 Final provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory consumer protection provisions of the country in which they have their habitual residence.
(2) If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Velbert.
(3) We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
